But Justice Siopis also granted Fontaine the right to lodge his own application for an injunction to prevent the company from holding its AGM in two weeks, on November 30.
The courtroom saga unfolded yesterday afternoon, following an announcement by Bounty to the ASX that one of its non-executive directors, Didier Murcia, had resigned.
Murcia was one of the directors Fontaine had been seeking to replace.
Managing director Laurence Roe did not elaborate on the circumstances surrounding the resignation, only saying that the company “thanks Murcia for all his efforts and wishes him well in his future endeavours.”
Roe was unavailable for comment to EnergyReview.net both yesterday and this morning.
Neither did Tom Fontaine return phone calls about whether he intends to apply for an injunction to stop Bounty’s AGM going ahead.
